Agent Nanny :Terms and Conditions

  1. These terms and conditions of business are between N. J Lavender trading as Agent Nanny(herein after called the Agency) and the employer client (herein after called the client) and are deemed to be accepted by the client by virtue of the completion of the employer's application form.
  2. The Agency operates as an introduction agency between prospective employer's and staff. The staff are not employed by the agency and all times are under the supervision, direction and control of the employer.
  3. The client agrees: a) to notify the agency immediately an engagement is agreed giving details of the date of commencement and the intended length. b) to pay the fee of the agency, within 14 days of the date of the invoice which can be raised as soon as the agreement has been agreed.
  4. The fee payable to the agency by the client for the introduction of an applicant is calculated as set out in the scale of fees. Invoices not paid within 14 days will be subject to a surcharge of 10% initially and a further 6% each subsequent month.
  5. Should the member of staff withdraw prior to commencement of employment , the engagement fee will be rebated in full. Should the relevant employment be cancelled by the employer prior to the commencement of employment, the permanent engagement fee will be rebated in full, less a service charge of £50 + VAT, provided that the employer has notified the agency in writing at least 7 days prior to the termination of the employment and has paid the agency's fee within 14 day's of the date of invoice.
  6. Should the employment terminate before the expiry date of 4 weeks, the engagement fee will be rebated in full, and the client charged at the emergency carer rate providing that the client notifies the agency in writing at least 7 days prior to the termination of the employment, has paid the agency's fee within 14 days of the invoice, and has honoured the conditions of employment.
  7. All information provided to clients is confidential. The passing on of an introduction to another employer which results in an engagement renders the client liable to payment of the agency's fee. (paragraph 4)
  8. An introduction fee calculated in accordance with paragraph 4 of these terms will be charged in relation to any applicant engaged as a consequence of or resulting from, an introduction by, or through, the agency even though the introduction may be made indirectly.
  9. The agency endeavours to ensure the suitability of any applicant introduced to the client. The client shall not withstanding satisfy himself as to the suitability of any applicant. The client shall be responsible for obtaining work, and other permits, for the arrangement of medical examinations and/or investigations into the medical history of any applicant and satisfy any medical and other requirements or qualifications required by law.
  10. The agency shall not be liable under any circumstances for any loss, damage, or expenses suffered or incurred by the client arising if a temporary employee deems to be inacceptable or not suitable the agency must be notified immediately in order that the agency can find a suitable replacement from or in any way connected with the agency seeking an applicant for the client or the introduction by the agency to the client of any applicant or the engagement of any applicant by the client.
  11. No variation can be made to these terms without the written consent of N.J. Lavender.
